{"id":1114,"date":"2022-01-14T14:23:33","date_gmt":"2022-01-14T13:23:33","guid":{"rendered":"https:\/\/blahalegal.cz\/deleni-pozemku\/"},"modified":"2022-01-14T14:23:33","modified_gmt":"2022-01-14T13:23:33","slug":"deleni-pozemku","status":"publish","type":"post","link":"https:\/\/blahalegal.cz\/de\/deleni-pozemku\/","title":{"rendered":"D\u011blen\u00ed pozemku"},"content":{"rendered":"\n<p>Uva\u017eujete-li o d\u011blen\u00ed pozemku, nevyhnete se p\u0159ed z\u00e1pisem nov\u011b vznikaj\u00edc\u00edch parcel do katastru nemovitost\u00ed n\u00e1v\u0161t\u011bv\u011b stavebn\u00edho \u00fa\u0159adu.<\/p>\n\n\n\n<p>Rozhodnut\u00ed o d\u011blen\u00ed nebo scelov\u00e1n\u00ed pozemk\u016f je toti\u017e jedn\u00edm z&nbsp;druhu \u00fazemn\u00edch rozhodnut\u00ed vyjmenovan\u00fdch v \u00a7 77 z\u00e1kona \u010d. 183\/2006 Sb., o \u00fazemn\u00edm pl\u00e1nov\u00e1n\u00ed a stavebn\u00edm \u0159\u00e1du (stavebn\u00ed z\u00e1kon), ve zn\u011bn\u00ed pozd\u011bj\u0161\u00edch p\u0159edpis\u016f (d\u00e1le jen \u201estavebn\u00ed z\u00e1kon\u201c).<\/p>\n\n\n\n<p>P\u0159esto\u017ee stavebn\u00ed z\u00e1kon umo\u017e\u0148uje i rychlej\u0161\u00ed proces pro povolen\u00ed takov\u00e9ho d\u011blen\u00ed, a to postupem dle \u00a7 82 odst. 3 stavebn\u00edho z\u00e1kona, i tehdy je povinen zkoumat pr\u00e1vn\u00edm p\u0159edpisem stanoven\u00e9 podm\u00ednky pro povolen\u00ed d\u011blen\u00ed pozemku.<\/p>\n\n\n\n<p>Jednou z\u00a0podm\u00ednek je mj. zaji\u0161t\u011bn\u00ed p\u0159\u00edstupu nov\u011b rozd\u011blen\u00fdch pozemk\u016f na ve\u0159ejn\u011b p\u0159\u00edstupnou pozemn\u00ed komunikaci, jak je stanoveno v \u00a7 12 odst. 1 p\u00edsm. b) a odst. 3 vyhl\u00e1\u0161ky \u010d. 503\/2006 Sb., o podrobn\u011bj\u0161\u00ed \u00faprav\u011b \u00fazemn\u00edho rozhodov\u00e1n\u00ed a stavebn\u00edho \u0159\u00e1du.<\/p>\n\n\n\n<p>Obdobn\u00e1 \u00faprava je pak stanovena i v \u00a7 20 odst. 3 vyhl\u00e1\u0161ky \u010d. 501\/2006 Sb., o obecn\u00fdch po\u017eadavc\u00edch na vyu\u017e\u00edv\u00e1n\u00ed \u00fazem\u00ed, dle kter\u00e9ho plat\u00ed, \u017ee <em>\u201ePozemek se v\u017edy vymezuje tak, aby sv\u00fdmi vlastnostmi, zejm\u00e9na velikost\u00ed, polohou, plo\u0161n\u00fdm a prostorov\u00fdm uspo\u0159\u00e1d\u00e1n\u00edm, umo\u017e\u0148oval vyu\u017eit\u00ed pro navrhovan\u00fd \u00fa\u010del a <strong>byl dopravn\u011b napojen na ve\u0159ejn\u011b p\u0159\u00edstupnou pozemn\u00ed komunikaci<\/strong>.\u201c<\/em><\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed spr\u00e1vn\u00ed soud stanovenou podm\u00ednku pro umo\u017en\u011bn\u00ed d\u011blen\u00ed pozemk\u016f opakovan\u011b potvrdil, kdy\u017e v\u00a0rozsudku ze dne 27. 9. 2017, \u010d. j. 1 As 166\/2016-38 mj. konstatoval, \u017ee napojen\u00ed pozemku na ve\u0159ejn\u011b p\u0159\u00edstupnou komunikaci mus\u00ed b\u00fdt <span style=\"text-decoration: underline;\">bezprost\u0159edn\u00ed<\/span>.<\/p>\n\n\n\n<p>Pokud tak chcete rozd\u011blit v\u00e1\u0161 pozemek na v\u00edcero parcel, je t\u0159eba vz\u00edt v potaz shora uveden\u00e9 p\u0159edpoklady, aby byl v\u00e1\u0161 z\u00e1m\u011br \u00fasp\u011b\u0161n\u00fd.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Uva\u017eujete-li o d\u011blen\u00ed pozemku, nevyhnete se p\u0159ed z\u00e1pisem nov\u011b vznikaj\u00edc\u00edch parcel do katastru nemovitost\u00ed n\u00e1v\u0161t\u011bv\u011b stavebn\u00edho \u00fa\u0159adu.
