Nebo bylo stavebn\u00ed povolen\u00ed p\u0159ed dokon\u010den\u00edm d\u00edla zru\u0161eno soudem? M\u00e1 takov\u00e1 situace vliv na platnost uzav\u0159en\u00e9 smlouvy o d\u00edlo?<\/p>\n\n\n\n<p>V\u00a0p\u0159\u00edpad\u011b nevyd\u00e1n\u00ed stavebn\u00edho povolen\u00ed by se nab\u00edzelo vych\u00e1zet z \u00a7 588 ob\u010dansk\u00e9ho z\u00e1kon\u00edku, kter\u00fd stanov\u00ed, \u017ee zavazuje-li pr\u00e1vn\u00ed jedn\u00e1n\u00ed k\u00a0pln\u011bn\u00ed od po\u010d\u00e1tku nemo\u017en\u00e9mu, je takov\u00e9 pr\u00e1vn\u00ed jedn\u00e1n\u00ed neplatn\u00e9.  Zah\u00e1jen\u00ed prov\u00e1d\u011bn\u00ed stavby bez povolen\u00ed vydan\u00e9ho stavebn\u00edm \u00fa\u0159adem je toti\u017e pochopiteln\u011b v rozporu se stavebn\u00edm z\u00e1konem.<\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud se v&nbsp;minulosti ji\u017e zab\u00fdval situac\u00ed, kdy bylo prov\u00e1d\u011bno d\u00edlo v rozporu s ve\u0159ejnopr\u00e1vn\u00edm povolen\u00edm. <\/p>\n\n\n\n<p>Jednalo se o situaci, kdy podle p\u016fvodn\u011b vydan\u00e9ho stavebn\u00edho povolen\u00ed m\u011bla b\u00fdt z\u0159\u00edzena jedna bytov\u00e1 jednotka, av\u0161ak v\u00a0pr\u016fb\u011bhu prov\u00e1d\u011bn\u00ed d\u00edla do\u0161lo mezi stranami k\u00a0dohod\u011b o z\u0159\u00edzen\u00ed dvou bytov\u00fdch jednotek. D\u00edlo tak bylo prov\u00e1d\u011bno v odli\u0161n\u00e9m rozsahu, ne\u017e pro jak\u00fd m\u011bl stavebn\u00edk vyd\u00e1no stavebn\u00ed povolen\u00ed.<\/p>\n\n\n\n<p>Nejvy\u0161\u0161\u00ed soud v\u00a0dan\u00e9m p\u0159\u00edpad\u011b jasn\u011b konstatoval, \u017ee smlouva o d\u00edlo, na jej\u00ed\u017e p\u0159edm\u011bt d\u00edla nebylo vyd\u00e1no stavebn\u00ed povolen\u00ed, je platn\u00e1 (viz rozsudek Nejvy\u0161\u0161\u00edho soudu ze dne 2. 2. 2015, spis. zn. 23 Cdo 2080\/2013).<\/p>\n\n\n\n<p>Lze tedy usuzovat, \u017ee i v\u00a0p\u0159\u00edpad\u011b, pokud do\u0161lo k\u00a0zah\u00e1jen\u00ed prov\u00e1d\u011bn\u00ed d\u00edla, ani\u017e by na po\u010d\u00e1tku existovalo stavebn\u00ed povolen\u00ed, bylo by v\u00a0kontextu v\u00fd\u0161e uveden\u00e9ho rozhodnuto o platnosti smlouvy o d\u00edlo. Jedn\u00edm z argumentem toit\u017e je, \u017ee stavebn\u00ed z\u00e1kon pamatuje i na tzv. dodate\u010dn\u00e9 povolen\u00ed stavby.<\/p>\n\n\n\n<p>V t\u00e9to souvislosti se v\u0161ak nab\u00edz\u00ed i jin\u00e1 ot\u00e1zka, a sice, zdali by nebylo mo\u017en\u00e9 uva\u017eovat v p\u0159\u00edpad\u011b nevyd\u00e1n\u00ed dodate\u010dn\u00e9ho stavebn\u00edho povolen\u00ed o z\u00e1niku z\u00e1vazku pro n\u00e1slednou nemo\u017enost pln\u011bn\u00ed. <\/p>\n\n\n\n<p>Dle \u00a7 2006 odst. 1 ob\u010dansk\u00e9ho z\u00e1kon\u00edku toti\u017e plat\u00ed, \u017ee <em>&#8222;Stane-li se dluh po vzniku z\u00e1vazku nesplniteln\u00fdm, zanik\u00e1 z\u00e1vazek pro nemo\u017enost pln\u011bn\u00ed. Pln\u011bn\u00ed nen\u00ed nemo\u017en\u00e9, lze-li dluh splnit za zt\u00ed\u017een\u00fdch podm\u00ednek, s v\u011bt\u0161\u00edmi n\u00e1klady, s pomoc\u00ed jin\u00e9 osoby nebo a\u017e po ur\u010den\u00e9 dob\u011b.&#8220;<\/em><\/p>\n\n\n\n<p>Nemo\u017enost pln\u011bn\u00ed m\u016f\u017ee spo\u010d\u00edvat nejen ve faktick\u00e9 p\u0159ek\u00e1\u017ece, ale i v p\u0159ek\u00e1\u017ece pr\u00e1vn\u00ed. <\/p>\n\n\n\n<p>Osobn\u011b se domn\u00edv\u00e1m, \u017ee by v takov\u00e9m p\u0159\u00edpad\u011b byl postup dle \u00a7 2006 odst. 1 ob\u010dansk\u00e9ho z\u00e1kon\u00edku nam\u00edst\u011b. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bylo zah\u00e1jeno prov\u00e1d\u011bn\u00ed stavebn\u00edho d\u00edla bez vyd\u00e1n\u00ed pat\u0159i\u010dn\u00e9ho ve\u0159ejnopr\u00e1vn\u00edho povolen\u00ed?
